Strategic AI Governance: Navigating Compliance and Risk in the AI Era

Most AI programs still rebuild governance three to five times. Teams document the same models and suppliers separately for the EU AI Act, DORA, U.S. sector rules, and customer-specific questionnaires. Each regime spawns its own inventory, incident playbook, and audit cycle. The result: duplicated evidence, month-long prep, and approval bottlenecks that delay deployments by one or two quarters in financial services, healthcare systems, and public sector deals.

The pattern is that scale treats AI governance as a shared spine, not a stack of one-off projects. Instead of managing the EU AI Act, DORA, and NIST SP 800-161 as separate efforts, leading organizations converge on a single control catalog, evidence spine, and incident playbook that map into multiple frameworks. That structure reduces overlapping documentation work across major regimes, cutting audit preparation from months to weeks and freeing teams to ship regulated workloads.

One evidence spine

Resilient AI programs collect incidents, vulnerabilities, training data provenance, and model-lifecycle artifacts once, then reuse that evidence for every auditor and regulator. Practically, that means using Open Security Controls Assessment Language (OSCAL) to keep controls, assessments, POA&Ms machine-readable, and maintaining a single SBOM-backed supplier inventory aligned to NIST SP 800-161. As new frameworks arrive, teams map them to the same evidence store instead of rebuilding documentation from scratch each time.

AI-specific assurance assets: AIBOM + SBOM + VEX (Vulnerability Exploitability eXchange)

Traditional security audits rely on asset inventories and change logs; AI requires the same level of traceability. An AI Bill of Materials (AIBOM) extends the software bill of materials (SBOM) with model-specific details, including training data sources, fine-tuning pipelines, third-party AI services, and safety evaluations. VEX reports track which vulnerabilities actually affect deployed models and components rather than listing every theoretical CVE. Together, these living artifacts sit on top of your SBOM and OSCAL catalogs and turn questions like “what’s in this model and is it safe to use?” into queries teams answer in minutes instead of weeks.

U.S. AI governance body

Following recent U.S. federal guidance, organizations name accountable AI officials and a cross-functional governance council across security, legal, compliance, product, HR, and operations. That body owns AI policy, risk appetite, and exceptions, and reports on rights-impacting and safety-impacting use cases to the board or risk committee at least quarterly.

An AI use-case inventory and risk tiers

Before you can govern AI, you need to know where it lives. The U.S. federal government more than doubled its cataloged AI use cases between 2023 and 2024 and now classifies hundreds as rights or safety-impacting. The private sector adopts this model: every team registers AI systems, labels that involve customer interactions, regulated data, or safety-impacting decisions, and applies stricter controls, testing, and documentation to those high-risk tiers.

These components only work as a workflow, not as a checklist. The governance council defines risk tiers and approval gates. Product and engineering teams register each AI use case against those tiers. High-risk systems must generate AIBOMs, SBOMs, and VEX reports as part of release, feeding those artifacts into the evidence spine in OSCAL form. Audit, security, and legal teams then query that evidence spine to answer regulator questions and internal incident reviews without launching new documentation sprints for each framework.

Global-by-default design

AI regulations focus on key principles: risk-based classification, documentation, human oversight, and rapid incident reporting. The EU AI Act formalizes this approach for high-risk systems, while the Digital Operational Resilience Act (DORA) requires financial institutions to treat major ICT incidents—including failures in AI-enabled systems—as reportable events with strict deadlines. Regulators demand initial notifications within hours, follow-up reports within days, and final reports within one month.

High-risk organizations must perform threat-driven penetration tests at least every three years. Developing controls, logging, and incident response playbooks to meet these standards early helps prevent rework when customers in Europe, the U.S., or Asia request proof that deployments comply with local regulations.

China’s multilateral play

At the World Artificial Intelligence Conference (WAIC) 2025, China unveiled a 13-point Global AI Governance Action Plan, alongside a proposal for a UN-related AI body that would give approximately 60–70 Global South member states more influence than they currently hold within G7 or OECD structures. The plan emphasizes open-weight models and technology transfer as a global public good and criticizes export-control regimes.  For vendors, the core operating model is more critical than rhetoric: a state-led, auditable AI approach with data residency, provider liability, and documented risk controls that align more closely with the EU AI Act’s high-risk regime than with voluntary U.S. commitments. Key markets—including the EU, India, Brazil, ASEAN, and rapidly digitizing African economies, which are projected to generate roughly US$230–300 billion in AI demand by 2030.

Convergence enforces a strict-first build order

Global vendors that adopt the state-led, documentation-heavy model as the baseline develop a single deployment pattern effective across those 60–70 markets. They align their evidence framework, AIBOMs, and incident playbooks with the strictest standards, then relax controls for lighter-touch environments guided by NIST’s AI Risk Management Framework and voluntary industry commitments. This strategy replaces country-by-country adjustments with one high-compliance template and region-specific toggles, preventing engineering teams from hard-coding assumptions that fail once a deal involves EU AI Act or China-aligned guarantees.

Failure modes typically appear first in regulated deals

Organizations that build AIBOMs without an accountable governance council end up with shelfware—static documents that nobody updates as models change. Teams that classify use cases but never enforce tier-based controls often face audit findings when regulators discover that “high-risk” labels do not align with test coverage, monitoring, or human oversight. Vendors that ignore global-by-default design re-litigate large deals, create country-specific forks, and lose budget cycles to retrofit work when a strategic customer upgrades its AI governance requirements.

Competitors that treat each framework as a one-off project negotiate every high-risk launch on the regulator’s timeline, not their own. That evidence spine turns AI governance from a reporting burden into a deployment accelerator across regulated markets.
